(As of August 2025)

These Terms of Use govern the rights, obligations, and responsibilities of members using the Christian matchmaking services provided by Elliezer (hereinafter referred to as “the Company”).
The Company is headquartered in New York, USA, and complies with the relevant privacy and consumer protection laws of the United States, the Republic of Korea, and other applicable jurisdictions. These terms apply to users in both the U.S. and Korea and are drafted with international standards in mind to ensure legal validity across regions.

Article 1 (Purpose)

These Terms of Use define the conditions, procedures, rights, obligations, and responsibilities related to the Christian faith-based matchmaking services (“Services”) provided by Elliezer.

Article 2 (Definitions)

1. “Company” refers to Elliezer and its operated website, app, platform, and related services.
2. “Member” means any individual who accesses the Service, agrees to the Terms, provides personal information, and completes registration.
3. “Matching” refers to the service of recommending or connecting compatible users based on the Company’s database and matching criteria.
4. “Profile” includes personal data, religious background, views on marriage, and personal values provided by the user.

Article 3 (Display, Effectiveness, and Changes of the Terms)

1. These Terms take effect upon being posted on the platform or otherwise communicated to users.
2. The Company may revise these Terms within the boundaries of applicable law and will notify users in advance.
3. Continued use of the Service after revisions will be deemed as acceptance of the revised Terms.

Article 4 (Services Provided)

1. The Company provides the following services:
   a. Faith-based matchmaking surveys and AI-powered recommendation system
   b. Intercessory prayer and manual recommendations by matchmaking partners
   c. Access to view profiles of potential matches
   d. Match result notifications and communication alerts
   e. Paid consulting and relationship coaching services
2. Service details may change according to Company policy.

Article 5 (Membership and Service Contract)

1. Membership is established through submission of personal information and survey responses via website or app, followed by agreement to these Terms and Privacy Policy and Company approval.
2. Membership may be denied in the following cases:
   a. Use of false information or identity theft
   b. Proven not to be legally single
   c. Values significantly misaligned with Christian marriage principles
   d. Violation of the Company’s core mission
3. Violation of truthfulness or spiritual standards after registration may lead to warnings, restrictions, or revocation of membership.

Article 6 (Member Obligations)

1. Members must not:
   a. Provide false or misleading information
   b. Use the service for purposes unrelated to marriage (e.g., financial scams, solicitation, proselytism)
   c. Engage in insulting, defamatory, or inappropriate behavior
   d. Tamper with or bypass technical safeguards
2. Members must keep their profile accurate and update any changes promptly.
3. Members are expected to respond sincerely to match proposals. Repeated unjustified rejections or non-responsiveness may result in service restrictions.

Article 7 (Company Obligations)

1. The Company shall not engage in any actions contrary to the law or public morals and shall strive to provide a stable and reliable service.
2. The Company shall take reasonable technical and administrative measures to protect member data as per its Privacy Policy.
3. The Company shall promptly investigate and address any service disruptions.

Article 8 (Account Management and Termination)

1. Members may request account deletion at any time through the platform or customer service.
2. Upon termination, personal data is retained only as necessary and deleted in accordance with the Privacy Policy.
3. Accounts may be restricted or terminated for:
   a. Identity theft or impersonation
   b. Repeated insincere responses or failure to engage in good faith
   c. Behavior contrary to Christian values
   d. Unethical or criminal behavior

Article 9 (Paid Services and Payment)

1. Some features such as intercessory prayer or personalized consulting are offered as paid services.
2. Payments are processed via third-party platforms such as Credit Card, Venmo, PayPal, Zelle, or Personal Check (U.S. banks only). The Company does not store payment information directly.
3. Refund policy:
   a. Full refund if requested within 7 days and before service use
   b. Partial or no refund after matching has begun
   c. No refund after 30 days from payment
   d. Donations or contributions are non-refundable

Article 10 (Information Protection and Security)

1. The Company protects user data in accordance with applicable laws and does not share it with third parties without consent.
2. Members are responsible for managing their login credentials and must not share them.
3. The Privacy Policy is available on the website at all times.

Article 11 (Disclaimers)

1. The Company shall not be held liable for:
   a. Disputes arising from false information provided by members
   b. Legal issues from personal interactions among members
   c. Service disruptions not caused by Company negligence
2. While the Company offers prayer and matching, it does not guarantee romantic outcomes or marriage.

Article 12 (Dispute Resolution and Governing Law)

1. The Member and the Company shall make sincere efforts to amicably resolve any disputes arising from or related to these Terms of Service or the use of the Service through mutual consultation.
2. If such consultation fails or the dispute persists, these Terms shall be governed by and construed in accordance with the laws of the State of New York, United States.
3. The primary court of jurisdiction for all disputes shall be a competent court located in the State of New York, specifically the United States District Court for the Southern District of New York, if necessary.
4. Members may utilize online dispute resolution systems designated by the United States federal government or the State of New York to the extent permitted by law.

Article 13 (Intellectual Property Rights)

1. All content and features provided by the Company—such as designs, questionnaires, surveys, algorithms, matching data, UI/UX, programs, and other materials—are protected under intellectual property law.
2. Members may not copy, distribute, transmit, modify, translate, publicly display, or commercially exploit any part of the Service without prior written permission from the Company.
3. The Company assumes no liability for legal disputes caused by a member’s violation of these terms and reserves the right to seek compensation for damages.

Article 14 (Advertising and Notices)

1. The Company may deliver service-related notices or advertisements through email, SMS, in-app notifications, banners, etc.
2. Promotional messages are sent based on prior consent, and users may opt out at any time.
3. Mandatory notices or important service changes will be announced via electronic documentation or website postings, which members are responsible for reviewing.

Article 15 (Service Changes and Discontinuation)

1. To maintain smooth operation, the Company may partially or entirely change or suspend the Service and will notify users in advance when possible.
2. In cases of urgent technical failures, legal changes, or security threats, prior notice may be waived and a post-notification may be issued.
3. If a paid user is affected by service suspension, unused portions of paid subscriptions will be refunded reasonably.

Article 16 (Usage Restrictions and Disciplinary Actions)

1. The Company may restrict, suspend, or terminate user accounts for the following reasons:
   a. Providing false information or impersonating others
   b. Disappearing after matching, avoiding meetings repeatedly, using profanity, harassment, stalking, etc.
   c. Engaging in commercial solicitation, non-Christian evangelism, political activity
   d. Repeated complaints or disturbance of community order
2. The Company may issue warnings or request clarifications before action, but reserves the right to act immediately in serious cases.
3. Repeat violators or malicious actors will be permanently banned and may be subject to civil or criminal liability.

Article 17 (Identity Verification and Information Validation)

1. To ensure safety and integrity, the Company may request verification such as phone number, email, or proof of church attendance.
2. Members must comply truthfully, and false submissions may result in service suspension without refund.
3. The Company may assess data reliability through internal or third-party methods; legal responsibility rests with the user.

Article 18 (Post-Match Responsibilities)

1. The Company provides opportunities for faith-based dating, but the decision to meet, date, or marry rests solely with the members.
2. The Company is not responsible for any disputes arising from actual dating, marriage, separation, or divorce.
3. The Company strongly encourages members to engage in prayerful discernment and to consult church leadership before making significant relationship decisions.

Article 19 (Refunds and Cancellation Policy)

1. Refunds for paid services are issued under the following conditions:
   a. Full refund within 7 days of payment if no service has been used
   b. Partial or no refund once survey responses or matching begins
   c. If 1:1 prayer or introduction service has been used, applicable portions are deducted
2. No refunds are issued if membership is restricted due to violations such as false information or misconduct.
3. Refund requests must be submitted via email to [contact@eliezermatch.org], and the Company will process them within 7 days.

Article 20 (Interpretation and Priority of Terms)

1. In case of conflicts between these Terms and individual service guides, notices, or policies, the specific terms shall take precedence.
2. Disputes regarding interpretation will be resolved in light of Christian values, common sense, and applicable laws.
3. In the event of a conflict between the Korean and English versions of these Terms, the Korean version shall prevail.

Article 21 (Governing Law and Jurisdiction)

1. These Terms of Service shall be governed by the laws of the State of New York, and all interpretations and applications thereof shall be subject to the relevant laws of New York.
2. In the event of any disputes arising between the Company and the Member in connection with this Service, both parties agree to submit to the exclusive jurisdiction of the United States District Court for the Southern District of New York or a state court located in New York City.

Article 22 (Supplementary Provisions)

1. These Terms of Use take effect on August 1, 2025.
2. The Company will provide at least 7 days’ notice of any changes to the Terms. Continued use after this period constitutes acceptance of the revised Terms.

본 약관은 엘리에셀(Elliezer) 플랫폼(이하 ‘회사’)이 제공하는 기독교 결혼 매칭 서비스를 이용함에 있어 회원의 권리, 의무 및 책임사항, 기타 필요한 사항을 규정함을 목적으로 합니다.
회사는 미국 뉴욕에 본사를 두고 있으며, 미국법과 대한민국법 및 기타 국가의 개인정보 보호 및 소비자 보호 관련 법령을 준수합니다. 이 약관은 미국 및 한국 사용자에게 모두 적용되며, 기타 국가에서도 법적 효력을 가질 수 있도록 국제 기준을 고려하여 작성되었습니다.

제1조 (목적)

본 약관은 엘리에셀(Elliezer)이 제공하는 기독교적 가치 기반의 결혼 중개 서비스(이하 ‘서비스’)의 이용조건 및 절차, 회사와 회원 간의 권리, 의무 및 책임사항 등을 규정함을 목적으로 합니다.

제2조 (정의)

1. ‘회사’란 엘리에셀이 운영하는 웹사이트, 앱, 플랫폼 및 기타 관련 서비스를 의미합니다.
   2. ‘회원’이란 회사의 서비스에 접속하여 본 약관에 동의하고, 개인정보를 제공하여 회원등록을 완료한 자를 말합니다.
   3. ‘매칭’이란 회사가 보유한 DB를 기반으로 회원 간의 교제 가능성을 고려하여 조건이 부합하는 상대를 추천 또는 연결해주는 서비스를 의미합니다.
   4. ‘프로필’이란 회원이 서비스에 등록한 개인 신상정보, 종교적 신념, 결혼관, 가치관 등의 정보를 포함합니다.

제3조 (약관의 명시, 효력과 변경)

1. 본 약관은 서비스 화면에 게시하거나 기타의 방법으로 회원에게 공지함으로써 효력을 발생합니다.
   2. 회사는 관련법을 위반하지 않는 범위에서 본 약관을 변경할 수 있으며, 변경된 약관은 제1항과 같은 방법으로 효력을 발생합니다.
   3. 회원은 변경된 약관에 동의하지 않을 경우 회원 탈퇴를 요청할 수 있으며, 변경 약관의 효력 발생일 이후에도 서비스를 계속 이용하는 경우에는 변경된 약관에 동의한 것으로 간주합니다.

제4조 (서비스의 종류 및 제공)

1. 회사는 회원에게 다음과 같은 서비스를 제공합니다:
   가. 신앙 기반 결혼 매칭 설문조사 및 자동 추천 시스템
   나. 사역자(매칭 파트너 디렉터)에 의한 중보기도 및 수동 추천
   다. 이성 회원의 프로필 열람 서비스
   라. 매칭 결과 및 소통 알림 서비스
   마. 유료 컨설팅 및 교제 조언 서비스
   2. 서비스의 구체적인 내용과 범위는 회사의 정책에 따라 추가, 변경 또는 중단될 수 있습니다.

제5조 (회원가입 및 이용계약 체결)

1. 회원가입은 웹사이트 또는 앱을 통해 개인정보 및 설문항목을 제출하고 본 약관 및 개인정보 보호정책에 동의한 후 회사의 승낙으로 이루어집니다.
   2. 회사는 다음의 경우에는 회원가입을 거절할 수 있습니다:
   가. 타인의 정보를 도용하거나 허위 정보를 기재한 경우
   나. 법적으로 미혼이 아님이 확인된 경우
   다. 기독교적 결혼 가치관과 현저히 다른 사고방식을 가진 경우
   라. 기타 회사의 운영 목적에 현저히 위배되는 경우
   3. 회원은 가입 후에도 진실성과 신앙적 기준을 위반하는 행위가 적발될 경우, 회사의 판단에 따라 경고, 제한 또는 회원 자격이 박탈될 수 있습니다.

제6조 (회원의 의무)

1. 회원은 다음 각 호의 행위를 해서는 안 됩니다:
   가. 허위 정보 기재 또는 타인 사칭
   나. 결혼 이외의 목적(예: 금전 요구, 영업, 종교포교 등)으로의 가입
   다. 상대방에 대한 모욕, 비방, 불건전한 언행
   라. 플랫폼의 기술적 보호조치를 무력화하려는 행위
   2. 회원은 본인의 프로필 정보를 정확하고 사실대로 유지하여야 하며, 변경사항이 있을 경우 즉시 수정해야 합니다.
   3. 회원은 매칭 상대에 대해 성실히 응답할 의무가 있으며, 정당한 사유 없이 반복적으로 거절하거나 연락두절 행위를 할 경우 서비스 이용이 제한될 수 있습니다.

제7조 (회사의 의무)

1. 회사는 관련 법령과 본 약관이 금지하거나 공서양속에 반하는 행위를 하지 않으며, 계속적이고 안정적인 서비스를 제공하기 위하여 최선을 다합니다.
   2. 회사는 회원의 개인정보 보호를 위하여 기술적, 관리적 보안 조치를 유지하고, 개인정보 보호정책에 따라 안전하게 처리합니다.
   3. 회사는 서비스 장애 시 신속하게 원인을 파악하고 정상화를 위해 합리적인 조치를 취합니다.

제8조 (계정 관리 및 해지)

1. 회원은 언제든지 웹사이트 또는 고객지원 채널을 통해 회원 탈퇴를 요청할 수 있습니다.
   2. 회원 탈퇴 시, 회사는 개인정보 보호정책에 따라 데이터를 일정 기간 보관 후 삭제합니다.
   3. 회사는 다음의 경우 회원의 계정을 제한하거나 삭제할 수 있습니다:
   가. 타인 명의 도용
   나. 반복적 허위 응답 또는 매칭 불성실 대응
   다. 기독교 가치관에 반하는 언행 지속
   라. 비윤리적 행위 또는 형사 범죄 행위 적발 시

제9조 (유료 서비스 및 결제)

1. 회사는 일부 프리미엄 기능 또는 중보 기도 사역, 맞춤형 컨설팅에 대해 유료 서비스를 제공합니다.
   2. 결제는 Credit card, Venmo, PayPal, Zelle, Personal Check (U.S. bank only) 등 제3자 결제 플랫폼을 통해 처리되며, 회사는 결제정보를 직접 저장하지 않습니다.
   3. 환불은 아래 기준에 따릅니다:
   가. 결제 후 7일 이내, 서비스 이용 전: 전액 환불
   나. 매칭이 1회 이상 진행된 경우: 부분 또는 불가
   다. 결제일로부터 30일 경과 시 환불 불가
   라. 헌금 성격의 비용은 환불되지 않음

제10조 (정보의 보호 및 보안)

1. 회사는 회원의 개인정보를 관련 법령에 따라 보호하며, 회원 동의 없이 제3자에게 제공하지 않습니다.
   2. 회원은 자신의 로그인 정보(ID, 비밀번호 등)를 관리할 책임이 있으며, 제3자에게 이를 누설하거나 공유해서는 안 됩니다.
   3. 개인정보처리방침은 본 약관과 별도로 제공되며, 회사 웹사이트에 항상 열람할 수 있도록 게시됩니다.

제11조 (면책조항)

1. 회사는 다음 사항에 대해 책임을 지지 않습니다:
   가. 회원의 허위 정보에 기인한 분쟁
   나. 회원 간 개인적 교류에서 발생한 법적 문제
   다. 회사의 귀책사유 없이 발생한 서비스 장애
   2. 회사는 신중한 매칭과 기도 중보를 바탕으로 서비스를 제공하지만, 특정한 결혼 성사 또는 연애 관계 발전을 보장하지 않습니다.

제12조 (분쟁 해결 및 준거법)

1. 회원과 회사는 본 약관 또는 서비스 이용과 관련하여 발생하는 모든 분쟁에 대해 성실히 협의하여 원만히 해결하도록 노력합니다.
2. 위 협의가 이루어지지 않거나 분쟁이 계속될 경우, 본 약관은 미국 뉴욕주 법(New York State Law)을 준거법으로 하며, 이에 따라 해석되고 집행됩니다.
3. 모든 분쟁에 대한 1차 관할 법원은 뉴욕주에 소재한 관할 법원, 특히 필요한 경우미국 뉴욕남부연방지방법원(Southern District Court of New York)으로 합니다.
4. 회원은 미국 법률이 허용하는 범위 내에서, 미국 연방정부 또는 뉴욕주에 의해 지정된 온라인 분쟁 해결 시스템을 사용할 수 있습니다.

제13조 (지적 재산권)

1. 회사가 제공하는 서비스에 포함된 디자인, 문항, 설문, 알고리즘, 매칭 데이터, UI/UX, 프로그램, 콘텐츠 등 일체는 지적 재산권의 보호를 받습니다.
   2. 회원은 회사의 사전 서면 동의 없이 어떠한 방법으로도 이를 복제, 유통, 전송, 수정, 번역, 공개 또는 영리적으로 활용할 수 없습니다.
   3. 회원이 본 약관을 위반하여 발생한 법적 분쟁에 대해 회사는 민·형사상 책임을 지지 않으며, 손해 발생 시 배상을 청구할 수 있습니다.

제14조 (광고 및 공지사항 고지)

1. 회사는 플랫폼 운영에 필요한 범위 내에서 이메일, 문자, 알림, 배너 등을 통해 서비스 관련 정보 또는 광고를 제공할 수 있습니다.
   2. 광고성 정보 발송은 사전 동의를 기반으로 하며, 회원은 수신 거부를 언제든지 요청할 수 있습니다.
   3. 서비스 변경 및 필수 고지는 전자문서 또는 웹사이트 게시를 통해 전달되며, 회원은 이를 숙지할 책임이 있습니다.

제15조 (서비스의 변경 및 중단)

1. 회사는 서비스의 원활한 운영을 위해 서비스의 전부 또는 일부를 변경하거나 중단할 수 있으며, 사전에 회원에게 고지합니다.
   2. 긴급한 보안 위협, 시스템 장애, 법령 변경 등 불가피한 사유로 인해 사전 고지가 어려운 경우 사후 공지할 수 있습니다.
   3. 서비스 중단으로 인해 유료 이용자에게 피해가 발생한 경우, 지불한 회비내 미사용 기간에 대해 합리적인 보상을 제공합니다.

제16조 (이용제한 및 경고 조치)

1. 다음 각 호에 해당하는 경우, 회사는 회원 자격을 제한, 정지 또는 상실 시킬 수 있습니다:
   가. 허위 정보 기재 또는 타인의 정보를 도용한 경우
   나. 매칭 후 연락 두절, 반복적인 만남 회피, 욕설, 스토킹, 성희롱 등 부적절한 언행
   다. 상업적 목적, 종교 외 선교, 정치 활동 등 서비스 목적 외 활동
   라. 반복적인 신고 접수 또는 커뮤니티 질서 저해
   2. 회사는 사전 경고 또는 소명 기회를 부여할 수 있으며, 긴급 사안은 즉시 제한할 수 있습니다.
   3. 경고 누적 또는 악의적 행위자는 재가입이 불가하며, 민·형사상 책임이 부과될 수 있습니다.

제17조 (신원 인증 및 정보 검증)

1. 회사는 회원의 안전한 매칭과 건전한 커뮤니티 유지를 위해 본인 확인 절차(전화, 이메일, 교회 출석 증명 등)를 요구할 수 있습니다.
   2. 회원은 요청 시 정직하게 응해야 하며, 허위 제출 시 이용제한 및 환불 불가 등의 불이익이 발생할 수 있습니다.
   3. 회사는 자체 기준 또는 외부 검증 기관을 통해 제공된 정보의 신뢰도를 판단할 수 있으며, 법적 효력은 개인의 책임입니다.

제18조 (매칭 및 만남 이후 책임)

1. 회사는 신앙과 인격을 바탕으로 한 교제 기회를 제공하나, 실제 만남, 교제, 결혼 여부는 전적으로 회원 간 자율적 결정입니다.
   2. 회원 간의 실제 교제, 결혼, 또는 사후 문제(별거, 이혼 등)에 대해서는 회사가 개입하거나 법적 책임을 지지 않습니다.
   3. 신중한 판단을 위해 충분한 기도와 상담을 권장하며, 교회 리더와의 상의는 필수로 간주합니다.

제19조 (환불 및 해지 정책)

1. 유료 서비스 환불 기준은 아래와 같습니다:
   가. 결제 후 7일 이내, 미이용 시 전액 환불
   나. 설문 응답, 매칭 시작 후: 일부 환불 또는 환불 불가
   다. 소개권 또는 1:1 기도사역 사용 시 해당 부분 차감 후 환불
   2. 허위정보 기재, 비매너 행위 등 회원 귀책 사유로 인한 제한 시 환불은 불가합니다.
   3. 환불은 이메일(contact@eliezermatch.org)로 신청해야 하며, 회사는 7일 이내 처리합니다.

제20조 (약관의 해석 및 우선순위)

1. 본 약관과 회사가 제공하는 개별 서비스 안내, 공지사항, 개인정보처리방침이 상충할 경우, 개별 약관 및 정책이 우선합니다.
   2. 약관의 해석상 분쟁이 발생하는 경우, 신앙적 가치와 일반상식, 관련 법령에 따라 해결합니다.
   3. 한글 약관과 영문 번역본이 상충할 경우 한글본을 기준으로 해석합니다.

제21조 (준거법 및 재판 관할)

1. 본 약관은 미국 뉴욕주 법(New York State Law)을 준거법으로 하며, 그 해석 및 적용에 있어 뉴욕주의 관련 법률이 우선 적용됩니다.
2. 회사와 회원 간에 본 서비스와 관련하여 분쟁이 발생하는 경우, 양 당사자는 미국 뉴욕남부연방지방법원(Southern District Court of New York) 또는 뉴욕시에 소재한 주 법원을 전속적 관할 법원으로 하며, 이에 따를 것에 동의합니다.

제22조 (부칙)

1. 본 약관은 2025년 8월 1일부터 적용됩니다.
   2. 약관 개정 시 회사는 7일 전 공지하며, 기존 회원은 공지 후 7일 이내 이의제기를 하지 않으면 동의한 것으로 간주합니다.
